Draft Limerick Agglomeration Noise Action Plan

The purpose of this privacy notice is to describe, in clear terms, the personal data that the Draft Limerick Agglomeration Noise Action Plan process collects about individuals, why it is needed, the legal basis, how it is used and how individuals may interact with the Council in relation to their personal data and the Draft Limerick Agglomeration Noise Action Plan.  It also outlines the right of individuals under data protection legislation.

1.0 Purpose of the Limerick Agglomeration Noise Action Plan

Personal data is processed as part of the plan in order to seek input from the public on their view to shape the Limerick Agglomeration Noise Action Plan 2024-2029 and to make submissions and observations as to the future development for this plan.

The Council is obliged to protect such personal data in accordance with the Data Protection Act 2018 and the provisions contained in the General Data Protection Regulation (GDPR).

2.0 Legal basis for the processing of personal data for the noise action plan

The legal basis to process data in the case of the noise action plan is the following:

  • Article 6(1)e of the GDPR - the processing is necessary for the performance of a task carried out in the public interest or in the exercise of an official authority vested in Clare County Council in conjunction with the Environmental Noise Regulations 2006 (as amended).

3.0 The categories of personal data concerned

In order to communicate with you, you will be asked for contact details. You do not have to provide all contact details but providing more, such as an email address makes it easier to communicate. Providing an email address allows Clare County Council to contact you about your submission should the need arise.

Personal data processed in the consultation for the Draft Limerick Agglomeration Noise Action Plan:

  • Name
  • Email address
  • Administrative area you live in (County Clare/County Limerick)

4.0 Processing and recipients of the data

There are no plans to transfer personal data to a third country or international organisation.

The personal data will only be reviewed by those directly connected to the administration of the public consultation process. If a submission relates to the administrative area of County Clare recipients of the personal data will be a limited number of Clare County Council staff as well as a small project team who will review submissions received.

If a submission relates to the administrative area of County Limerick then that submission, including any personal details submitted, will be forwarded to Limerick City and County Council. 5.0 The retention period for the data

Clare County Council subscribes to the national policy for retention and destruction of Local Authority records.

6.0 Data subjects have a range of data rights

  • Right of access by the data subject
  • Right to rectification
  • Right to erasure ('right to be forgotten')
  • Right to restriction of processing
  • Right to data portability
  • Right to object and automated individual decision-making

7.0 The right to lodge a complaint with the supervisory authority

If you are not satisfied with a decision on your request for access to data or have concerns about personal data processing, you have the right to make a complaint to the Data Protection Commission, Canal House, Station Road, Portarlington, Co. Laois, Ireland. Before doing so it is recommended that you contact Clare County Council (dpa@clarecoco.ie) to establish the circumstances.  We may be in a position to resolve the problem in a timely manner.
