End-of-Life Vehicles (ELV) Regulations

What the vehicle owner must do

S.I. No. 281 European Union (End-Of-Life Vehicles) Regulations, 2014 as amended, place an obligation on vehicle owners. Where the registered owner of an end-of-life vehicle intends to discard that vehicle as waste, he or she is required to deposit that vehicle at an authorised treatment facility for appropriate treatment and recovery. If the vehicle is not roadworthy, the services of a permitted waste collector must be used to transport the ELV to the facility.

A key aspect of this End-of-Life Vehicle regulation (ELV) is that you cannot be charged for disposing of the car. In effect, you pay a levy when you buy a new car, and this covers the cost of finally disposing of it in future. Note that there may be a charge for collecting a vehicle.

An authorised treatment facility or ATF is a facility where the collection and storage and treatment of end-of-life vehicles may take place. Authorised treatment facilities must operate under a waste licence or waste facility permit, as appropriate, in accordance with Section 39 of the Waste Management Acts 1996, as amended, and associated regulations.

It is therefore an offence under waste management legislation to undertake the collection or storage or treatment of end-of-life vehicles without the appropriate authorisation.

When seeking to dispose of an end-of-life vehicle, it is important that the registered owner of the vehicle ensures that they receive a Certificate of Destruction for the vehicle from the ATF. This is a statutory document and cannot be copied or amended by any person.

These facilities "depollute" the vehicle - removal of all fluids, batteries, catalytic convertors and any asbestos. Then the metal and the recyclable plastics are separated for recycling.

If vehicles are abandoned, the last registered owner is legally responsible for it, so if you sell a car it is vital that you complete the ownership details. It is the owners responsibility to get the vehicle to an ATF. Once the vehicle has been scrapped, you will receive a certificate to this effect.
