Cathaoirleach John Crowe opened the meeting and welcomed all present.  He commenced by thanking Cllr.  Michael Begley for Chairing the July Meeting in his absence and expressed thanks to all for their support following a recent family bereavement.

N19 Update

The EIAR (Environmental Impact Assessment Report) and NIS (Natura Impact Statement) documentation for the N19 Shannon Airport Access Road Improvement Scheme is currently undergoing legal review. This process will come to a conclusion over the coming months culminating in a briefing to MD councillors.

It is hoped that following legal review we will be submitting this project for Statutory Consent later in 2025.  Phase 5 (Enabling and Procurement) & Phase 6 (Construction) will progress thereafter which are subject to timely consents, no legal challenge, funding, etc. The construction contract is estimated to be in the region of 18 months in duration.

Shannon Town and Environs Flood Relief Scheme

As part of the ongoing Value Engineering exercise a site visit was carried out in the area around the Fuel Depot adjacent to the Shannon GC driving range. RPS are currently preparing a site investigation scope for this area. The Arborist Survey was successfully carried out over a week in mid-August. Associated draft deliverables are currently being prepared by the surveyors.

A Request for Quotes has been issued to multiple companies for the provision of pre-planning Archaeology Testing across the scheme. MARA have recently advised that a Pre-Application Request Form is to be completed in order to assess the requirement for a Marine Usage License (MUL) for the proposed SI works.

Outdoor Recreation Infrastructure Scheme (ORIS)

Successful projects under Measure 1 and the Project Development Measure of the 2024/2025 Outdoor Recreation Infrastructure Scheme were announced on the 14th of August, by Minister Calleary.

The following Shannon MD projects were awarded funding under this round of ORIS:

Ø  Newmarket on Fergus: long and short sweep walking routes (8 km).

Ø  Parteen Riverside Walk: feasibility study for a riverside walk connecting Westbury & Shannon Banks to Parteen Village.

Clare FM Summer Tour broadcast from Sixmilebridge

Shannon Municipal District was delighted to welcome the Morning Focus Clare FM radio team to Sixmilebridge. The popular and award-winning show was broadcast from the Sixmilebridge Hub and the Shannon MD Leas Cathoirleach Michael Begley, Senior Executive Officer, Suzie Clifford, Senior Executive Engineer, Tom Mellett, Executive Engineer, John Strand and Supervisor, Pat Kearney were interviewed on the many projects and works that are currently being delivered across the Shannon Municipal District. The broadcast was an opportunity to inform the listeners of the vital work and important role that the Municipal District team plays in improving the quality of life for everyone in the district. There were a variety of interesting guests from the community, and we thank them all for their participation.

 

Mr. Farrell concluded his presentation by thanking the Shannon MD Councillors and staff for their assistance and support since he commenced as Director of the Shannon MD. He acknowledged the strong working relationship that exists between the Members and staff.  Thanks was also expressed to the outdoor roads crew for their work and commitment in carrying out their day-to-day duties throughout the MD. 

The contribution by the other stakeholders including Shannon Group, which play a critical role not only for the Shannon MD but for the County as a whole, Shannon Chamber of Commerce and the OPW on the delivery of major capital projects within the MD, was commended.  A special acknowledgement was extended to the community groups within the MD for their co-operation and support with the Members and staff of the MD. 

 

The Member raised the following:

  • The Members expressed their sincere gratitude to Mr. Farrell for his contributions during his tenure as Director of the Shannon MD. They extended their best wishes to him in his new role and looked forward to their continued working relation in his capacity as Director of the Housing Delivery, Infrastructure Provision & Land Activation Directorate.
  • Shannon Town & Environs Flood Relief Scheme: it was highlighted that home and business owners in Shannon Town are unable to get flood insurance.  A request was made for more detail to be included in the “Letter of Comfort” that is issued by the Council in respect of flood defences. 
  • Parteen Riverside Walk – while the funding to progress a feasibility study was welcomed, concern was expressed that this level of funding may not be adequate to complete the study.

In response to the above Mr. Farrell stated that

  • The importance of the flood relief scheme for Shannon is recognised.  The team in Clare County Council, the Consultants and the OPW are eager to progress the scheme. However, there are a number of environmental, technical and legal elements and every avenue is being explored to progress the scheme as efficiently as possible.  Regular updates will be provided at the various stages.  A “Letter of Comfort” will be reviewed in the context of providing additional information within the realm of our works. 
  • In regard to the funding available under the Parteen Riverside Walk, it is considered that the €50k allocation will be sufficient for the feasibility study.
  • Housing is currently a critical issue and the Chief Executive has given a clear indication on the need for the delivery of housing and housing activation.  In terms of social housing, Clare County Council are ahead of target but this will need to be maintained.  Emphasis will also be placed on private housing activation.  Work will continue with all the various stakeholders in the delivery of vital infrastructure to facilitate the provision of housing.   

 

Item no. 6: Roads – update by Tom Mellett, Senior Executive Engineer.

  • Staff are continuing to work through the issues raised and recorded on the Central Records Management (CRM) system by the Members and the public.
  • Road maintenance works are being carried out in the district.
  • Overlay works have been substantially completed with one remaining in Bóthar Bealach Brí, Shannon and this is expected to be completed in the coming weeks.
  • Footpath works are continuing in Slí na Mara, Shannon, Tullyvarraga Cresent, Shannon, Westbury and Shannon Banks, Corbally.
  • Preparation works for pedestrian crossing throughout the MD are being carried out.
  • Works have continued to be carried out in pump station 3 in Drumgeely, Shannon – these works are critical to the management of the storm water network in the town.  
  • Work is due to commence later this week on the Local Improvement Scheme (LIS) in Portdrine, Cratloe.
  • Road marking works are being carried out at various locations throughout the MD.
  • Hedge cutting works are continuing since early September.
  • Grass maintenance is continuing in the MD.
  • A tree surgeon will be commencing at the end of the month and will be carrying out works throughout the district for a 6-week period.

 

The following matters were raised by the Members:

  • Clonlara needs to be included in the tree maintenance work programme.
  • The volume of work carried out in the MD is significant and is acknowledged by the Members.  These works should be highlighted for the public.
  • Newark Road, Westbury requires road markings.
  • It was highlighted that communications from other departments in Clare County Council needs to be improved. 
  • A programme of works for the opening of outlets and clearing of gullies to be carried out in light of recent heavy rainfalls and with the onset of the winter months. 
  • Maintenance of trees in Newmarket on Fergus and Shannon is required.
  • Are there particular routes for hedge cutting and how are these routes determined?
  • Local Improvement Scheme – additional funding was welcomed but more funding is required in this area and when can new applicants apply. 
  • Drainage works required in Westbury and Shannon Banks.
  • Access road to the GAA grounds in Westbury requires works to alleviate ponding/surface water. 

 

In response to the above Tom Mellett replied as follows:

  • The LIS scheme is not open to new applicants, the backlog is currently being worked on. 
  • The selection of routes for hedge cutting is primarily focused on road safety and busy routes.  In Shannon, regional routes and local primary routes are prioritised while concern raised by the Members and the public, particularly around junctions to improve visibility. 
  • Drainage works have been carried out over the summer months.  The contractor is due to return in the coming weeks and further works will be carried out on gullies in urban areas.  The Shannon MD roads crew are continuously opening gullies and outlets in rural areas of the MD. 
  • In regard to the access road to the GAA grounds in Westbury, Corbally a lack of infrastructure for drainage and a possible issue with the surface of the road and how it was laid originally can only be addressed with a road overlay and this has a significant cost.  New gullies or channels can be introduced where possible.

Due to the volume of traffic and the number of housing estates from the Shannon Road, Sixmilebridge to St. Finnachta’s National School that safety measures be looked at for the safety of children and pedestrians.

The Limerick Road is one of the busiest roads in Sixmilebridge and urgently needs traffic calming measures such as speed bumps or similar.

I urgently require that speed bumps and safety measures be installed from the Railway Bridge on the Rossmanagher Road to the Shannon Road junction.

Shannon Municipal District will carry out a speed survey on this road and introduce new road marking in this area.

 

Cllr. Pat O’Gorman requested clarification on what a speed survey entails.

Tom Mellett responded that a speed survey is carried out over a 7-day period, 24 hours per day.  It records the direction vehicles are travelling in, the number and type of vehicle such as car/van/motorbike/truck etc, and the speed range vehicles are travelling at.  This provides comprehensive detail which enables a better design outcome.

To ask the Senior Executive Officer to explore how we might expedite impactful roundabout design concepts in Shannon, potentially including aviation themed sculptures reflecting Shannon’s Aviation and Industrial history.

The Shannon Municipal District is working proactively with the Shannon Aviation Museum, the Michael Guinee Charitable Trust, the Shannon Chamber and industry representatives to establish roundabout design concepts. This group will also identify appropriate funding streams to deliver inspiring roundabouts in Shannon.

The Shannon Municipal District is currently working with a landscape artist to create a design for the main routes into Shannon. We have consulted the Shannon Tidy Town Team on our plans for the main roads and they are working in partnership with us to deliver on your proposal.

That the Senior Executive Officer, brings together the relevant bodies (An Garda Siochana & Clare County Council) to endeavour to re activate the existing camera network.

John Corry A/Senior Executive Officer, Corporate Services replied as follows:

The cameras in the Shannon Town Park are not activated, as the legal basis for their activation is not in place.  Members will be aware that the use by public bodies of surveillance technologies receives considerable attention and the Data Protection Commission has been very clear in issued decisions and guidance about surveillance in parks and on streets for purposes related to the prevention, detection, investigation or prosecution of offences.  The law on the matter has also changed.

 The Garda Síochána (Digital Recording Devices) Act, 2023 is now the relevant piece of legislation.  In particular, part 5 of that Act, concerning authorisation for installation and operation of CCTV for the prevention, investigation and prosecution of crime is awaiting commencement.  Under the 2023 Act, an application could be made to the Commissioner of An Garda Síochána by either a local authority or by An Garda Síochána to install public realm surveillance, accompanied by a data protection impact assessment and documented evidence as to the necessity and proportionality of the proposed surveillance.    Under the 2023 Act, a code of practice is to be put by the Commissioner of An Garda Síochána for the approval of the minister to become the statutory code to apply to public CCTV surveillance schemes.  

The commencement of part 5 of the 2023 Act and the statutory code of practice is awaited.

This motion received the full support of all the Members and the consensus was to progress this matter through discussions with the Gardaí.

That the Shannon MD engage with colleagues in the Heritage Section and the Department of Heritage nationally to devise a plan to repair and better maintain the footpath to Kilnasoolagh Church and Graveyard, Newmarket-on-Fergus, on health and safety grounds.

This footpath is recorded as Protected Structure No. 61 in the Volume 4 of the County Development Plan 2023-2029. It is described as an 18th century limestone kerbed footpath from Kilnasoolagh Church to Newmarket-on-Fergus.

As such any works carried out here must be compatible with the original footpath and may require extensive investigation as part of a design process.

This Office will engage with Clare County Council’s Heritage Officer in order to determine a way forward.

That the Shannon MD provide more regular weeding and surface maintenance on footpaths in the village and on the approach roads to Newmarket on Fergus (Dromoland Road, Carrigoran Road, Drumline Road etc).

Weed Treatment in this area is primarily carried out by our larger road sweeper, hired in for the purpose, this has been supplemented by direct weed treatment during the early summer.  Further weed treatment is scheduled for later this month.

That an audit be conducted of areas across the Municipal District such as Shannon Town Park, public walkways, repeat areas for illegal dumping or other areas that the Council feel would benefit from the installation of CCTV and that a plan for progressing implementation of cameras be devised.

Brendan Flynn, Senior Executive Engineer, Department of Physical Development (Environment) replied as follows:

The Environment Section will undertake a comprehensive audit of public complaints relating to illegal dumping in public areas. This review will incorporate relevant data provided by the Community Warden and data from our complaints management system and will cover a five-year period. Upon completion of the data compilation and analysis, the Environment Section will assess and determine any necessary actions to address the issues identified.

 

It was agreed to take Item no. 16 & 23 together.

Discussions with local Community Groups on this matter have taken place. Locations have been considered. Before this project advances any further, an assessment around the legal framework for providing such an amenity will be conducted.

 

Ms. Suzie Clifford added that a visit to a dog park will be added to the itinerary for the trip to Belfast next week and a visit to the dog park in Mungret will also be organised. She stated that funding for the construction and maintenance of a dog park will also have to be identified.

I am requesting the MD to please look into the possibility of being able to give new community organisations financial support to the get them started.

Bernadette Haugh, Senior Executive Officer, Rural Development Directorate replied as follows:

Over the past two years the Rural & Community section has supported new community groups/organisations with initial seed money to support new and establishing community groups (formed within the previous 12 months) to assist them to cover once-off start-up vouched expenditure towards hiring meeting rooms, printing, publicity, etc. Support has been provided through direct engagement with the Rural & Community Development Officers where emerging groups have been linked in and have demonstrated the need for the Community Group, the sustainability of the group post set up, and the need in the local community. The direct engagement through the Rural & Community Development Officers is the catalyst by which groups can avail of this support based on vouched expenditure. This startup funding can enable new groups to grow capacity and to focus on their purpose, having a particular focus on the LECP and Clare Rural Development Strategy which can lead to stronger relationships, capacity growth and a sense of shared responsibility. This funding is administered through the RCDO community engagement work programme and is subject to annual budget allocations and internal audit requirements.

 

Cllr. James Ryan requested further clarification in respect of the response to this Notice of Motion and it was agreed that this would be requested from Ms. Bernadette Haugh, SEO, Rural Development Directorate

 

Ms. Suzie Clifford further added that the challenges faced by Community Groups is acknowledged by the executive. She stated that a meeting took place recently between the Shannon MD and St Francis Credit Union. The basis of the meeting is to work in partnership with the Credit Union to support Community Groups funding requirements. St. Francis Credit Union have agreed to work closely with the Shannon Municipal District Office to support Community Groups within the District.

I request that this MD would look at alleviating a flooding issue at Cappa South, Sixmilebridge as this area floods every time it rains, and this in turn forces the drives of the cars onto the opposite side of the road. This is one of the busiest roads in the Shannon MD.

Regular checks at this location are carried out and the vacuum tanker is deployed to clear the pipelines. The vacuum tanker will visit the area during the Autumn.

I request that this MD would put a plan in place for the maintenance of the Shannon Estuary Loop Walk.  As the same issues seem to be occurring every year, for example the cutting back overgrowth on the footpaths, seating, signage and gym equipment.

Tom Mellett, Senior Executive Engineer, Shannon Municipal District replied as follows:

We have previously carried out upgrades to long sections of this path. Any maintenance must be in line with our budgets and is measured against other demands on resources for priority. All cutting is carried out by hand due to the sensitive nature of the area. We also must take the bird nesting season into account when carrying out works.

Shannon Park Run also advise us when clearing is required. Vegetation management at this location has occurred several times this year, in response to very high rates of growth being observed. Seating that has been damaged has been replaced. The outdoor exercise equipment is inspected annually and certified. Cleaning of signs is scheduled, however, some of the waste is down to bird fouling and graffiti which we cannot control. In addition to this we erected a panoramic view type sign on behalf of Shannon Tidy Towns. All of the above is a recognition of the importance of the embankment walks to the local community.

I request that this MD would review the Radisson Road that's joining the Wood Road, Cratloe as there is no place for a car to pass a lorry on this road.  There are more lorries now moving on this road with a factory expanding nearby.

An examination of this location has shown that any widening will require agreements and possible land acquisition from third parties. A number of measures to discourage speeding have been installed along this road in 2024 and 2025.

To examine the feasibility of increasing safe pedestrian routes between Upper Meelick and Lower Meelick. 

Tom Mellett, Senior Executive Engineer, Shannon Municipal District replied as follows:

An assessment of the requirement on this road will be required. However, capital funding for any project will have to be identified. There are a number of physical restraints along this road i.e the rail line and the river which will make designing a path difficult.

Proposals to extend a footpath along this route have been considered in the past. To date a suitable funding stream has not been identified, this Office continues to seek funding for a path along this road.

Item no. 28:  AOB

  • Cllr. James Ryan informed the meeting of his involvement in an upcoming exhibition developed by people living with an acquired brain injury in the De Valera Library on Monday the 29th of September.  This exhibition showcases creativity, resilience and expression through art.
  • Cllr. John Crowe requested that a letter be issued to the Clare Oireachtas Members seeking their support following a recent article in a national newspaper on a proposal to increase the passenger numbers at Dublin Airport and the negative impact this will have on Shannon Airport.  This received the full support of all the Members.
  • Cllr. Tony Mulcahy expressed best wishes to Ms. Mary Considine as she departs her role as CEO of Shannon Airport Group.  The Members acknowledged Ms. Considine’s work to date in growing Shannon Airport, her willingness at all times to engage with the Members and all stakeholders.  Best Wishes were also extended to Mr. Ray O’Driscoll as he takes on the role of Interim CEO of Shannon Airport Group. 
  • Cllr. John Crowe stated that following on from a Notice of Motion that was passed at the July meeting in regard to honouring Mayor Dani Hunter and further discussions at the CPG Meeting in early September, it was proposed that Mayor Hunter would be honoured with a Cathaoirleach award.  This request will be sent to Corporate Services for inclusion in the next event for the Cathaoirleach Awards.  This was seconded by Cllr. Tony Mulcahy and agreed by all the Members.
