Playgrounds privacy notice

The purpose of this privacy notice is to describe, in clear terms, the personal data that will be processed as part of the delivery by the Council Community Playgrounds insured by Clare County Council.

Introduction

This privacy notice explains why the personal data is needed, the legal basis, how it is used and how individuals may interact with the Council in relation their personal data. It also outlines the rights of individuals under data protection legislation.


The Council also has a privacy statement which is a general document about how we approach data protection as an organisation and is available on the website or on request.

The Personal Data involved

Personal data processed is:

  • Name, contact phone number, email address, postal address
  • Photos or videos of projects and participants. These may be used by Clare County Council in press releases/articles; the Council’s or annual reports and other reports and promotional material; on the Council’s website and on Council social media sites.

The Legal Basis

The legal basis to process personal data is the following:

  • Article 6(1)( e)The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council. The processing of the personal data is based on: the Local Government Act 2001 as amended, sections 65 and 66.
  • Article 6(1)( a)Where photos and images of people are concerned, the data subject has given consent to the processing of his or her personal data for one or more specific purposes; the data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

The purposes of the processing

Community Playgrounds are supported by Clare County Council by providing insurance to the community playgrounds who meet the relevant requirements set out in the playground agreement.
Personal data is gathered as part of the delivering insurance for relevant community playgrounds. The Council is obliged to protect such personal data in accordance with the Data Protection Act 2018 and the provisions contained in the General Data Protection Regulation (GDPR). The purpose of the processing of personal data is to:

  • Promote the safety of the users of the community playgrounds and communication between Clare County Council and the Playground Committee.
  • Enable Clare County Council to contact the relevant committee members in the event of breach of the conditions in the playground agreement and on receipt queries/complaint from a member of the public.

Recipients

Access to the data is generally limited to authorised personnel dealing with Insured Community Playgrounds within the Council.
Third party access to personal data is not allowed. Access requests shall be processed in accordance with the Data Protection Act 2018, the GDPR and the Council’s data protection policies and procedures.

Records Retention Policy

How long will the records be retained?

Retain correspondence and reports for duration of Committee and subsequently offer all correspondence, minutes and reports to Archivist. Retain for 7 years after which insurance granted, then destroy. Updated information will be sought yearly on the committee and if a member leaves their information will be archived.

Right of complaint to the Office of the Data Protection Commissioner

If you are not satisfied with a decision on your request for access to data or have concerns about personal data processing, you have the right to make a complaint to the Data Protection Commission, Canal House, Station Road, Portarlington, Co. Laois, Ireland. Before doing so it is recommended that you contact Clare County Council (DPA@clarecoco.ie) to establish the circumstances. We may be in a position to resolve the problem in a timely manner.
