Privacy Notice Draft Clare County Biodiversity Action Plan 2025-2031

The purpose of this privacy notice is to describe, in clear terms, the personal data that the Draft Clare County Biodiversity Action Plan 2025-2031 processes about individuals, why it is needed, the legal basis, how it is used and how individuals may interact with the Council in relation their personal data. It also outlines the rights of individuals under data protection legislation.

Purpose of the Draft Clare County Biodiversity Action Plan 2025-2031

Clare County Council wants you ensure you understand how we will manage your data. As part of the process for the development of the Clare County Biodiversity Action Plan 2025-2031, Clare County Council will be accepting public submissions and carrying out other such forms of public consultation. This requires the use of personal data i.e. name, address and email address etc. and is being carried out to ensure that local representatives and the community are appropriately informed throughout the Biodiversity plan-making process.

The Legal Basis

The data subject has given consent to the processing of his or her personal data for a specific purpose. The data subject shall have the right to withdraw his or her consent at any time (by emailing biodiversity@clarecoco.ie) or in writing to Clare County Biodiversity Action Plan 2025-2031, Planning Section, Economic Development Directorate, Clare County Council, Áras Contae an Chláir, New Road, Ennis, Co. Clare, V95 DXP2). The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawn.

Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. Clare County Council may for the purpose of its functions under Section 63(1)(d) and Section 64(2)(b) of the Local Government Act 2001 as amended.

The categories of personal data concerned

Personal data processed in relation to submissions on the Draft Clare County Biodiversity Action Plan 2025-2031 is:

  • Name
  • Address
  • Email

Processing and recipients of the data

A limited number of Clare County Council Staff, including staff in the Forward Planning Unit, will have access to the personal data, those staff members are specifically involved in the administration and development of the Clare County Biodiversity Action Plan 2025-2031.

The retention period for the data

All personal data will be held confidentially and will be retained for as long as is necessary to fulfil the purposes for which it is intended. It is envisaged that the Clare County Biodiversity Action Plan 2025-2031 will be finalised in late 2025.

All information collected in relation to public consultation on the Clare County Biodiversity Action Plan 2025-2031 will be held in compliance with the National Retention Policy for Local Authority Records for retention and destruction of Local Authority records.

The right to lodge a complaint with the supervisory authority

If you are not satisfied with a decision on your request for access to data or have concerns about personal data processing, you have the right to make a complaint to the Data Protection Commission, Canal House, Station Road, Portarlington, Co. Laois, Ireland. Before doing so it is recommended that you contact Clare County Council (DPA@clarecoco.ie) to establish the circumstances. We may be in a position to resolve the problem in a timely manner.
